General Terms and Conditions (GTC)

1. Property and Seller Information

Conditions for the sale of goods to MKM Metals e.K. is that you or her. Your company owns the goods offered. The owner, the account holder (bank or PayPal) as well as the person specified in the checkout. Company must be identical. You confirm that you tax your income yourself and do not engage in commercial transactions. Private sellers must be of age and fully capable of business.

For commercial sellers, the respective tax requirements apply to trade.

MKM Metals e.K. reserves the right to request a copy of a valid official photo ID. Your ID data will be treated strictly confidentially and will not be passed on to third parties.

2. Prices

All published purchase prices are: Net prices. Online prices apply exclusively to online sales. There is no price guarantee for deliveries without online processing.

3. Role of the website

The MKM Metals e.K. operates the website [www.mkm-metals.de] for the purchase of metals and scrap according to the material specifications defined on the website.

Depending on the location and trading status of the seller, MKM Metals e.K. acts as a direct buyer or as a liable intermediary when purchasing goods. Credit notes and purchase confirmations are issued exclusively by MKM Metals e.K. as soon as a weighing slip is available and the goods correspond to the information. For the payment of the credit, the time limits set out in Section 5 apply.

4. Shipping, pick-up, price guarantee, price adjustments and cancellations

MKM Metals e.K. undertakes to send or deliver goods within: 5 working days to accept at the agreed kiloprice after completion of the online sale, provided that the information is in accordance with the present product or material. In the case of self-delivery, a period of acceptance of: 2 working days.

After expiry of these deadlines (or an unforeseen negative exchange price change) MKM Metals e.K. is entitled to sell the goods to the current daily prices to buy. Price changes can be made both upwards and downwards.

Changes in prices may also be made where the actual condition or type of material of the goods sent does not correspond to the grade indicated on sale. In this case, MKM Metals e.K. Contact the seller to clarify if:

• the goods are returned at the seller's expense,
• a price adjustment is made;

• the goods are to be disposed of.

If the scrap metal doesn't match the grade. Everyone can do something – so we don't just dispose of anything like that. If the test results in a different grade, we will contact you and you will decide how to proceed:

• Adjust price – we evaluate according to the actually delivered grade.
• Partial purchase – we buy the part that fits.
• Return – the goods go back to you. You will bear the costs of the return.
• Disposal – we dispose of the goods for you.

The weighting is the most important. The amount displayed in the online sale is an estimate based on your quantity. After receipt of the goods we weigh on calibrated scales, check the sorting and prepare the weighing slip. Only this amount will be paid.

Technical errors or errors in the price indication (e.g. B. Typing errors) remain reserved.

5. Payment of the goods

7. Collection

(a) Transportable packaging

The goods must be collected at the agreed pick-up date Packed ready for transport Stand by. Suitable for transport means: Standard pallets packed, secured against slipping and removable with a lift truck or forklift. Reusable pallets are not remunerated.

If the goods are not packed in transportable packaging at the time of collection, MKM Metals e.K. is entitled to: refuse to accept and purchase. The same applies if the goods are not ready or the journey to the agreed pick-up location is not possible.

(b) Cost of empty journey

If the goods cannot be taken up for any of the reasons set out in Section 7(a), the seller shall bear the costs of empty journey. This applies regardless of whether MKM Metals e.K. has picked up its own fleet or commissioned a freight forwarder. The costs actually incurred for this journey shall be calculated and proof shall be provided on request.

In this case, the collection costs already paid will be charged against the costs of empty journeys.

(c) Advance payment of collection costs

8. Time limit for delivery

In addition, MKM Metals e.K. reserves the right to refuse acceptance of the goods after this period and to withdraw from the contract.

9. Nature of the product
